13. Provisions related to the appointment of the executive head: (1) The Government of Nepal shall make the recommendation according to section 11 upon the recommendation of the committee when appointing the executive head of the public institution in accordance with the prevailing law.

(2) According to subsection (1). When appointing, among the three candidates recommended by the public institution executive head recommendation committee, the candidate deemed suitable based on efficiency, professional competence and leadership ability shall be appointed. The term of office of the executive head of a public institution shall be four years. (4) Notwithstanding anything else written in this order, the Government of Nepal shall appoint an employee working in the gazetted first grade or above of the civil service as the vacant executive head of the public institution while maintaining his position. There will be no obstacle. Considering the appointment as vacant, the board can choose the candidate and this appointment will be maintained only until the candidate is recommended by the board.
